Covid 19 aka the Corona Virus is giving all of us professional event photographers a hard time. Every day it seems to be getting worse. Having it go from 500 guest events, to 250 guest events, to less than 50 to ...nothing was painful. Nowhere near the level of pain it is bringing to families and friends who are dealing with this virus physically and having to be quaranteened, in hospitals, ICU if not worse :(
With that being said I want to take this time to discuss some of the legal aspects we may be facing with postponed events and even cancellations. There are FOUR main areas I wanted to touch base on. The first is the Force Majeure clause you probably have been reading up about. The second is when is it better to use Retainer vs when to use Deposit. The third is situations called Anticipatory Breach and the last area is Mitigating Damages.
